Preamble

The Indiana Young Democrats shall endeavor to stimulate in young people an active interest in governmental affairs, increase the efficiency of our government, maintain the viability of our free institutions, advocate issues and legislation from the perspective of the young electorate, and contribute to the growth and influence of the ideals and philosophies of the Democratic Party, and to forthrightly represent the legitimate aspirations of the young citizens of the state of Indiana and this nation.

Article 1 Name, Affiliations and Definitions

Section A

The name of this organization shall be INDIANA YOUNG DEMOCRATS.

Section B

Indiana Young Democrats shall operate in partnership with the Indiana Democratic Party State Central Committee.

Section C

Indiana Young Democrats shall:

  1. Operate as the official Indiana state chapter of Young Democrats of America.
  2. Maintain a relationship as a “parent” organization to all Indiana chapters of College Democrats of America via the Indiana College Democrats Caucus.
  3. Maintain a relationship as a “parent” organization to all Indiana chapters of High School Young Democrats via the Indiana High School Democrats Caucus.
  4. Maintain a relationship as a “parent” organization to all chapters of the Indiana Young Democrats.

Section D

Use of the following terms with capitalized letters shall be defined as follows:

  1. Executive Committee: The Indiana Young Democrats Executive Committee shall be made up of the elected officers, district chairs, and vice chairs. Further details will be defined in Article 3 Section A.

  1. State Central Committee: Refers to the Indiana State Central Committee as defined in the Rules of the Indiana Democratic Party.

Article 2 Membership

Section A

All United States residents registered to vote in Indiana, unless unable to register, or physically residing in Indiana no younger than fourteen (14) years of age and any person who has not yet reached the age of thirty-six (36) are eligible to be members of Indiana Young Democrats.

Section B

All Indiana Young Democrats members who are full-time students of an accredited Indiana high school or home school are eligible to be members of the Indiana High School Democrats Caucus of Indiana Young Democrats.

Section C

All Indiana Young Democrats members who are full-time students of an accredited Indiana college or university are eligible to be members of the Indiana College Democrats Caucus of Indiana Young Democrats.

Section D

Indiana Young Democrats shall not discriminate on the basis of religion, ideology, gender, race, ethnicity, sexual orientation, gender identity, ancestry, disability, or national origin.

Section E

Indiana Young Democrats shall put forth its best efforts to be representative of all of Indiana on the basis of geographical distribution.

Section F

All prospective members of Indiana Young Democrats shall, before assuming membership in Indiana Young Democrats:

  1. Pledge to uphold the Indiana Young Democrats constitution;
  2. Submit to the Treasurer of Indiana Young Democrats an annual fee, as determined by the Executive Committee. If sufficient funds exist for operation, the Executive Committee may, by a majority vote, waive the annual fee for a determined period; and
  3. Become a member of the local chapter governing their residence.

Section G

Indiana residents older than thirty-six (36) years of age are eligible to be alumnus, non-voting members of the Indiana Young Democrats.

Article 3 Executive Committee

Section A

The Executive Committee shall consist of the following positions as voting members:

  1. President
  2. Vice President of Political Affairs
  3. Vice President of Membership and Outreach
  4. Vice President of Equity and Inclusion
  5. One District Chair for each U.S. Congressional District in Indiana
  6. One District Vice Chair for each U.S. Congressional District in Indiana
  7. National Committeewoman
  8. National Committeeman
  9. President of the Indiana College Democrats Caucus
  10. Vice President of the Indiana College Democrats Caucus
  11. President of the Indiana High School Democrats Caucus
  12. Vice President of the Indiana High School Democrats Caucus
  13. Treasurer
  14. Secretary

A parliamentarian shall also serve on the Executive Committee as a non-voting, ex-officio member.

Section B

All voting members of the Executive Committee shall carry one (1) vote. A voting member of the Executive Committee who is unable to attend a meeting may designate a proxy to represent and vote in the voting member’s place. To designate a proxy a voting member shall provide written notice to the President that the voting member will be absent from the meeting and the name of the proxy. Notice may be given by email or other electronic communications. The proxy shall be a member of the Indiana Young Democrats in good standing.

Section C

For conduct of official business, quorum shall be reached with the attendance of either:

  1. The President, Vice President of Political Affairs, Vice President of Membership and Outreach, National Committeewoman, National Committeeman, Secretary, and Treasurer or;
  2. A majority of voting members.

Section D

The Executive Committee shall serve as the legislative body of Indiana Young Democrats, with the powers delineated in this constitution, and may pass binding resolutions to compel members of Indiana Young Democrats.

Section E

The Executive Committee shall meet no less than four times per year. The Executive Committee will make reasonable efforts to hold meetings in differing geographical locations around the state.

Section F

The Secretary shall, in connection with other elected and appointed officers, post notice of Executive Committee meetings as scheduled on the Indiana Young Democrats official web site or via email announcement. The Secretary, or a member of the Executive Committee designated by the President, shall post notice of Executive Committee meetings as scheduled on the Indiana Young Democrats social media accounts.

Section G

All Executive Committee meetings shall be open to attendance by all members of Indiana Young Democrats.

Section H

The Executive Committee will observe the following notification process for all regular meetings:

  1. Anyone with new business to be considered by the Executive Committee shall submit written notice to the Secretary and the President no later than 72 hours before a regularly scheduled meeting.
  2. The President shall send an Agenda to all members of the Executive Committee at least 48 hours prior to each regularly scheduled meeting. The membership may elect to amend the agenda at the time of the meeting with the approval of a majority vote of the Executive Committee.
  3. A financial report shall be provided by the Treasurer or their designated proxy at each regularly scheduled meeting.

Article 4 Officers

Section A

Indiana Young Democrats shall maintain the following positions:

    1. President
    2. Vice President of Political Affairs
    3. Vice President of Membership and Outreach
    4. Vice President of Equity and Inclusion
    5. District Chairs, numbering one for each U.S. Congressional District in Indiana
    6. District Vice Chairs, numbering one for each U.S. Congressional District in Indiana
    7. National Committeeman
    8. National Committeewoman
    9. Treasurer
    10. Secretary
    11. Parliamentarian
    12. Vice President of Equity and Inclusion

Section B

Any member of Indiana Young Democrats is eligible to hold office, subject to the following provisions:

  1. Shall have maintained membership.
  2. Shall be in good standing with Indiana Young Democrats and any chapter with which said member is associated.
  3. Shall be no younger than eighteen (18) years of age and cannot be older than thirty-five (35) years of age on the first Tuesday following the first Monday of the November immediately following the date of election.

Section C

The length of a term for all members elected or appointed to a position provided for in Article 4, or any position appointed by the President, shall be one-year period beginning on the third Saturday in March.

Section D

The President shall serve as the chief executive officer and official spokesperson of Indiana Young Democrats. Duties of the President shall include, but will not be limited to the following:

  1. Shall represent Indiana Young Democrats at official functions of the Indiana Democrat Party and Young Democrats of America.
  1. The President may, only under extenuating circumstances, appoint a member of the Executive Committee to serve as proxy for the President on a per event basis.
  1. Shall preside over Executive Committee meetings.
  2. Shall appoint chairs of all standing and created committees and any created positions, unless otherwise specified by a resolution of the Executive Committee, the Bylaws or Constitution.
  3. Shall oversee and direct all subsidiaries of Indiana Young Democrats, except as otherwise specified by the Bylaws or Constitution.
  4. Shall submit to the Executive Committee recommendations regarding endorsements of public questions, legislative initiatives, or other matters of statewide concern.
  5. Shall inform Indiana Young Democrats membership of the political activities and interests of Indiana Young Democrats.
  6. Shall maintain access to and oversight of funds of Indiana Young Democrats, exercising fiduciary powers only at the request of the Treasurer or under extenuating circumstances under which the Treasurer is not willing or able to carry out their duties.
  7. Shall serve as a voting member of the Indiana Democratic Party State Central Committee, carrying one vote.

Section E

The Vice President of Political Affairs shall exercise the following powers and responsibilities:

  1. Shall prepare and present to the Executive Committee a political action plan on a quarterly basis or as requested by the Executive Committee.
  2. Shall be responsible for the development of the official policy positions of Indiana Young Democrats and maintaining involvement with political races statewide, with the following specified duties:
      1. Shall maintain awareness of political activity in Indiana.
      2. Shall develop and maintain contact with Indiana Democratic Party and any elected officials or campaigns determined to be of importance to the success of Indiana Young Democrats.
  1. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.

Section F

The Vice President of Membership and Events Outreach shall exercise the following powers and responsibilities:

  1. Shall serve on the Events / Community Outreach Committee.
  2. Shall direct Indiana Young Democrats in fundraising and cost operations with input from the Executive Committee.
  3. Shall be responsible for the creation and oversight of official community outreach and membership events.
  4. Shall prepare and present to the Executive Committee a membership development report on a quarterly basis or as requested by the Executive Committee.
  5. Shall endeavor to increase the membership of Indiana Young Democrats.
  6. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.
  7. Shall endeavor in the cultivation of additional local Young Democrat chapters within the State of Indiana.
  8. Shall prepare and present pending Indiana Young Democrat charters to Executive Committee for approval with Indiana Young Democrat approved charter documents.

Section G

A District Chair shall serve as a member of the Executive Committee and exercise the following powers and responsibilities:

    1. Shall serve as chief executive officer of his or her respective district, with the corresponding powers and responsibilities of the President of Indiana Young Democrats, except where it conflicts with the constitution, bylaws, or resolutions of the Indiana Young Democrats Constitution and/or the Executive Committee.
    2. Shall strive to develop membership and activity in the county chapters in his or her district.
    3. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.
    4. Shall strive to host a local Indiana Young Democrat fundraiser or campaign on behalf of Indiana Young Democrats.

Section H

A District Vice Chair shall serve as a member of the Executive Committee and assist the District Chair in executing the powers and responsibilities in Section 7 of this article.

Section I

The National Committeeman and National Committeewoman shall serve as members of the Executive Committee and exercise the following powers and responsibilities:

  1. The National Committeeman and National Committeewoman shall represent Indiana Young Democrats at official functions of Young Democrats of America.
  2. The National Committeeman and National Committeewoman shall maintain compliance with the requirements and direction of Young Democrats of America.
  3. The National Committeeman shall be of the gender male.
  4. The National Committeewoman shall be of the gender female.
  5. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.

Section J

The Treasurer shall act as the treasurer of record of Indiana Young Democrats and exercise the following powers and responsibilities:

  1. Shall maintain and disburse funds of Indiana Young Democrats as directed.
  2. Shall prepare and submit to the Indiana Election Division all required campaign finance reports and notify the President and Vice President of Political Affairs upon submission.
  1. Shall prepare and present to the Executive Committee a budget report no later than ten (10) days following the conclusion of any campaign finance reporting period required by the Indiana Election Commission or as requested by the Executive Committee.
  1. Shall maintain access to and oversight of funds of the Indiana Young Democrats, exercising fiduciary powers only at the request of the President or Executive Committee.
  2. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.

3 Shall prepare and present to the Executive Committee a membership payment report on a quarterly basis or as requested by the Executive Committee.

Section K

The Secretary shall maintain all records of Indiana Young Democrats not maintained by the Treasurer and exercise the following powers and responsibilities:

  1. Shall maintain records of all motions, votes, and adopted resolutions of the Executive Committee and minutes of officially convened Executive Committee meetings.
  2. Shall maintain the accuracy and completion, to the best of his or her abilities, of the official record of membership of Indiana Young Democrats.
  3. Shall create the official ballot and count and record the results for state convention elections.
  4. Shall serve on the Rules/Elections Committee.
  5. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.

Section L

The Parliamentarian shall oversee the proper conduct of Indiana Young Democrats and exercise the following powers and responsibilities:

  1. Shall advise the Executive Committee and serve as a non-voting member of the Executive Committee.
  2. Shall maintain a working knowledge of the constitution, bylaws, and adopted resolutions of Indiana Young Democrats and Robert’s Rules of Order.
  3. Shall advise the Executive Committee of any actions that are in conflict with the constitution, bylaws, or adopted resolutions of Indiana Young Democrats or Robert’s Rules of Order.
  4. Shall render to the Executive Committee an immediate ruling on any point of order requested by a member of Indiana Young Democrats.
  5. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.
  6. Shall advise the Executive Committee and not vote as an Executive Member.
  7. Shall serve on the Rules/Elections Committee.

Section M

The Vice President of Equity and Inclusion shall serve as members of the Executive Committee and exercise the following powers and responsibilities:

  1. Shall reinforce Indiana Young Democrats’ organizational commitments to equitable value of all members on the basis of religion, ideology, gender, race, ethnicity, sexual orientation, gender identity, ancestry, disability, or national origin.
  2. Shall maintain anti-discrimination compliances with the requirements and direction of the Indiana Young Democrats, Indiana Democratic Party, and the Democratic National Committee.
  3. Shall serve as chair on the Inclusion Committee and advise the Executive Committee of any actions the Inclusion committee proposes.
  4. Shall endeavor to attend every officially convened meeting of the Executive Committee or designate a qualified proxy to serve instead.

Section N

Upon vacancy of an office provided for in Article IV, the following procedure should be enacted:

  1. The President shall nominate a candidate to fill the vacancy within thirty (30) days following the vacancy.
  2. The Executive Committee shall confirm the nomination within thirty (30) days of the nomination.
  3. In the case of a vacancy in the position of the President, the following procedure shall be observed:
      1. The Vice President of Political Affairs shall post the notice of vacancy with a call for nominations and convene a meeting of the Executive Committee to be held no sooner than fourteen (14) days and no later than thirty (30) days from the date of the vacancy.
      2. The Secretary shall receive all nominations no later than seventy-two (72) hours prior to the aforementioned meeting.
      3. The Executive Committee shall review nominations and vote at the aforementioned meeting for a new President to serve for the remainder of the unexpired term.
  4. All nominees shall be confirmed by a majority vote of the Executive Committee.

Article 5 Committees

Section A

The Executive Committee shall maintain the following standing committees:

  1. Rules/Resolutions Committee
  2. Campaign Committee
  3. Finance Committee
  4. Events and Community Outreach Committee
  5. Training and Chapter Development Committee
  6. Inclusion Committee

Section B

Standing committees shall meet no less than (4) times per year and at the request of the President or Executive Committee.

Section C

Each member of the Executive Committee shall serve on no less than one (1) standing committee.

Section D

Additional committees may be created by the President or the Executive Committee.

Section E

Each member of Indiana Young Democrats shall serve on no less than one (1) standing committee per approval of the committee chair unless otherwise specified by the President or Executive Committee.

Section F

The President shall appoint the Committee chairs with the approval of the majority of the Executive Committee.

Article 6 Districts

Section A

Indiana Young Democrats shall maintain one district for each U.S. congressional district in Indiana.

Section B

Each District shall elect a member of Indiana Young Democrats to serve as District Chair   and Vice Chair, as provided for in Article IV. The District Chair serves as the chief executive officer of the District, comprising the corresponding county chapters.

Section C

District Chair may appoint District Officers and convene District Committees, which shall include the District Vice Chair, as they see fit and exercise the following powers and responsibilities:

  1. Shall reinforce Indiana Young Democrats’ organizational commitments to make sure members of the Indiana Young Democrats maintain local membership to a local Young Democrat organization.
  2. Shall maintain a working relationship with Indiana County, District, and State Party Officers and Committees.
  3. Shall conduct a Young Democrat Congressional meeting and meet no less than (4) times per year and at the request of the President or Executive Committee.

Article 7 Chapters

Section A

Any group of individuals meeting the threshold for membership under Article II, Section 1, may organize a local Young Democrats chapter and petition the Indiana Young Democrats for recognition in accordance with this Constitution.

Section B

Upon receiving a petition for recognition, the following process will be observed:

  1. The Parliamentarian shall review the petition within thirty (30) days to ensure the submission complies with all aspects of this Article.
  2. Upon competition of his or her review, the Parliamentarian shall issue a report to the Executive Committee recommending acceptance, amendment, or rejection of the petition.
  3. The Executive Committee shall act on the recommendation of the Parliamentarian at its next regularly scheduled or special meeting.
  4. Acceptance of any petition for membership shall be by majority vote of the Executive Committee.

Section C

  1. Each chapter shall create and maintain the following:
    1. Name
    2. Bylaws
    3. Chief executive officer
    4. Contact information and meeting details
    5. Contact information for its members, including, but not limited to, name, phone number, age, email address, and mailing address.
  2. Each chapter shall maintain the accuracy and completion, to the best of their abilities, of the official record of membership.
  3. Each chapter shall prepare and provide the official record of membership on a bi-annual basis or as requested by the Executive Committee to their respective Indiana Young Democrat District Chair and Vice Preside of Membership and Outreach

Section D

No section of a chapter’s bylaws may conflict with this constitution, bylaws, or adopted resolutions of Indiana Young Democrats, Indiana Democratic Party, or Democratic National Committee.

Section E

Each chapter shall submit an annual report to the IYD Executive Committee detailing the activities of the chapter.

Section F

The Executive Committee may expel any local chapter from the Indiana Young Democrats for actions inconsistent with the Indiana Young Democrats or the Indiana Democratic Party. Such action shall require a two-thirds vote of the Executive Committee.

Article 8 Caucuses

Section A

Indiana Young Democrats shall maintain the following caucuses:

  1. Indiana College Democrats Caucus
  2. Indiana High School Democrats Caucus

Section B

Each caucus may operate independently of Indiana Young Democrats provided such actions do not conflict with the constitution, bylaws, or adopted resolutions of Indiana Young Democrats, Indiana Democratic Party, or Democratic National Committee.

Section C

Each caucus shall elect a President and Vice President who shall serve on the Executive Committee as provided for in Article III.

Section D

Indiana Young Democrats shall serve as a parent organization to each caucus and assist, where possible, the caucuses’ respective missions.

Section E

  1. Each caucus shall create and maintain the following:
    1. Name
    2. Bylaws
    3. Chief executive officer
    4. Contact information and meeting details
    5. Contact information for its members, including, but not limited to, name, phone number, age, email address, and mailing address.
  2. Each caucus shall maintain the accuracy and completion, to the best of his or her abilities, of the official record of membership
  3. Each caucus shall prepare and provide the official record of membership on a bi-annual basis or as requested by the Executive Committee to the Vice President of Membership and Outreach.

Section F

Each caucus shall submit an annual report to the Executive Committee detailing activities of the caucus.

Article 9 State Conventions and Elections

Section A Indiana Young Democrats’ State Convention

Indiana Young Democrats shall annually hold a state convention. All Indiana Young Democrat members and official chapters shall be invited to be in attendance.

  1. The Indiana Young Democrat State Convention (“IYD State Convention”) shall be held annually in the months of November, January or February.

Section B Registration

The Secretary will certify a list of all eligible members of the Indiana Young Democrats eligible to vote.

  1. The Secretary shall gather and maintain the following information for each candidate seeking to hold an elected position within the Indiana Young Democrats:
    1. Name
    2. Indiana Young Democrat elected position seeking
    3. Name of local Young Democrat Chapter candidate maintains membership to
    4. Telephone, Email Address, and Mailing Address
    5. Age, email address, and mailing address
  2. The Secretary shall submit the names of all eligible candidates to the Indiana Young Democrat President no later than forty-five (45) days before elections to make sure all absentee ballots are available thirty (30) days before elections.
  3. The Secretary and President shall provide notification to the Executive Committee the names of all eligible candidates prior to the absentee ballots distribution deadline.
  4. The Secretary shall provide a certified candidacy listing to all eligible members of the Indiana Young Democrats eligible to vote and create a media advisory.

Section C Elections

Indiana Young Democrats shall hold an election for each position provided for in Article IV Section 1 at each IYD State Convention. All Indiana Young Democrat members in good standing shall be eligible to vote. Members will only vote for the District Chair representing their address of residency. Winners are determined in the following manner:

  1. A majority of eligible votes cast.
  2. If no candidate receives a majority, a runoff election comprising the two (2) candidates receiving the most votes shall be held immediately. A plurality of eligible votes cast shall determine the winner.

Section D Absentee Voting

Absentee ballots shall be made available to those members wishing to vote in a state convention election and unable to attend the IYD State Convention in the following manner:

  1. Absentee ballots may be requested with the Secretary no sooner than thirty (30) days and no later than five (5) days prior to a IYD State Convention election.
  2. Upon receipt of request, the Secretary shall within twenty-four (24) hours provide an electronic copy of the official ballot.

Section E Candidacy

Any Indiana Young Democrat member who meets all required specifications as defined in Article 4, may declare candidacy for only one of the positions provided for in Article 4 in the following manner:

  1. Shall submit a written declaration of candidacy to the Secretary of Indiana Young Democrats no sooner than ninety (90) days and no later than forty-five (45) days prior to the date of the election.
  2. If no declaration of candidacy is made for a position forty-five (45) days before the date of the election, the vacancy will be filled per Article 4, Section L.

Article 10 Amendments

Section A

Amendments to this constitution shall be approved by a two-thirds vote of the Executive Committee or a two-thirds vote of the Membership at two separate officially convened meetings.

Section B

Proposed amendments shall be first submitted in writing to the Secretary, Parliamentarian, and Rules Committee. Upon receipt of a proposed amendment, the Secretary shall immediately post said proposed amendment on the Indiana Young Democrats official web site or similarly accessible point of information. The Parliamentarian and Rules Committee shall verify the form and nature of the amendment within fifteen (15) days.

Section C

Upon a report from the Parliamentarian and Rules Committee, the amendment will be scheduled for a vote before the next regularly scheduled Executive Committee Meeting. The sponsor or the Executive Committee may also elect to refer the matter directly to the membership at the next regularly scheduled general membership meeting.

Section D

The Secretary shall, upon ratification of a constitutional amendment, record said changes and make available upon request a copy of the previously written constitution for one hundred eighty (180) days.

Article 11 Impeachment and Removal of Members

Section A

The Executive Committee may impeach any member of the Executive Committee in the following manner:

    1. Shall be approved by two-third vote of the Executive Committee and render said position vacant.
    2. Shall be first submitted as a request to the Executive Committee in writing, no less than seven (7) days and no more than fourteen (14) days prior to a vote, by a member of the Executive Committee and shall include grounds for impeachment.
    3. Upon receipt of Articles of Impeachment, the Secretary shall post said Articles on the Indiana Young Democrats official web site or similarly accessible point of information and transmit a copy of the Articles to the officer in question.
    4. Grounds for impeachment can include, but are not limited to, the following:
      1. Openly supporting a candidate from another political party (i.e. Republican, Libertarian, etc.) for public office or deliberately aiding an opposing political party.
      2. Involvement in illegal or unethical behavior of a felony nature in accordance with Indiana Code and U.S. Federal Law.
      3. Gross Dereliction of duty leading to the substantial harm and detriment of the Indiana Democratic Party or the Indiana Young Democrats.
    5. The Executive Committee shall schedule and conduct a trial within (14) days of receiving Articles of Impeachment and shall allow equal time for both the plaintiff and defendant to argue their positions prior to a vote.

Section B

Indiana Young Democrats membership may impeach any member of the Executive Committee in the following manner:

  1. Shall submit to the Secretary a petition containing the consensual signatures of no less than fifty-one percent (51%) of the Indiana Young Democrats membership and the grounds for impeachment.
  2. Upon receipt of a petition to impeach, the Secretary shall post said petition on the Indiana Young Democrats official web site or similarly accessible point of information and transmit a copy of the petition to the officer in question and the Executive Committee.
  3. A Special general membership meeting shall be called by the Executive Committee within fourteen (14) days, at which both the defendant and a representative of the petition as the plaintiff shall argue their positions prior to a vote.
  4. Two-third of the general membership shall be required in order to impeach an officer and render said position vacant under this section.

Article 12 General Provisions

Section A

Every member of Indiana Young Democrats, prior to expenditure of funds not appropriated by the Executive Committee:

  1. Shall request and receive the majority approval of the Executive Committee.

Section B

A candidate for public office may not be endorsed by the Indiana Young Democrats or any subsidiary organization, unless:

  1. The candidate is the official nomination of the Democratic Party for a general election ballot or special election ballot,
  2. The candidate is the sole contender of the Democratic Party for a specific office, as reflected on a primary ballot or special primary ballot, or,
  3. The candidate is a candidate for election by the Indiana Democratic Party State Central Committee.
  4. This section shall not apply to local chapters under Article 7.

Article 13 Emergency Provisions

Section A

The Executive Committee may, provided an emergency situation is identified by a member of the Executive Committee and documented by the Secretary, per a two-thirds vote at an officially convened meeting, suspend any one Article, Section or Subsection, of the Constitution except Article 11, Article 13, or Article 14 and the Sections and Subsections contained therein.

Section B

The constitution shall not be suspended for more than thirty (30) days from the date of Emergency Declaration by the Executive Committee and may be reinstated in a lesser period of time by a majority vote of the Executive Committee, as incorporated in a motion declaring the Emergency or under a separate motion made at any legally convened meeting of the Executive Committee or the General Membership.

Article 14 Ratification

Section A

All articles shall be in effect immediately upon ratification of this constitution, except for Article 9 Section B, Article 9 Section D, and Article 9 Section E, which shall be effective June 27, 2010.

Section B

This section shall be amended to read only “This constitution was ratified on” and the date of ratification, immediately upon ratification of this constitution.
